Lady Justice is Blind. Is Love? Is the Marriage Legal?

If you have not tuned in yet, you’re missing out: the drama on the show “Love is Blind” is keeping everyone on the edge of their seat. And, if the setting looks familiar to you, that’s because this season is filmed in our hometown: Charlotte, North Carolina!


The popular reality dating show explores whether two people can fall in love without physical appearance as a factor. The contestants start in pods, where they can speak to one another but don’t know what the other person looks like. As their emotional connection grows, the couples decide if they want to get engaged – if it’s a “yes!” then they finally get to meet their fiancé in person. The next few weeks are filled with moving in together, meeting family and friends, and serious conversations about their compatibility. Less than forty days after the experiment begins, the couples decide whether to tie the knot at the altar.   


So far, this season has generated a lot of questions. Will Kenneth ever put his phone down? Is there a parking lot outside Lost & Found? And, the most important question (at least for us family law attorneys) – are the marriages legitimate?


The short answer is yes. Despite how complicated a divorce can be, there are only a few requirements for a marriage to be considered valid in North Carolina:


(1)   ELIGIBILITY. You must be over 18 to legally marry in our state. There is an exception, though, for minors ages 16 – 18. Anyone in that age range may get married so long as they have their parents’ or guardians’ consent.


(2)   CEREMONY. You and your partner must intend to enter into a marriage, and there must be a proper ceremony (either religious or civil) to establish them as spouses. The ceremony must be executed before an ordained minister, a minister authorized by a church, or a magistrate, and there must be a declaration that the persons are officially married. A ceremony following the traditions of a federally or state-recognized Indian Nation or Tribe will also be considered valid.


Contrary to common belief, failing to obtain a marriage license will not necessarily invalidate your marriage. Our courts have reiterated that a marriage license is not a prerequisite to a legally-recognized marriage. However, the individual officiating your wedding will likely require that you have one, as the officiant can be penalized for marrying a couple without a license. 


Based on North Carolina’s laws, the marriages between the contestants are, in fact, legal. Don’t worry -- that’s our only spoiler!
